FEDERAL ECONOMIC RECOVERY SPENDING
BOROUGH OF KEYPORT NOTICE TO BIDDERS Notice is hereby given that sealed proposals will be received by the Borough of Keyport, Monmouth County, New Jersey for Route 35 and Route 36 Jughandle Improvements and opened and read in public in the Council Chambers at the Keyport Borough Hall, 70 West Front Street, Keyport, New Jersey 07735 on Thursday, November 19, 2009 at 10:00 A.M. prevailing time. Contract Documents and Plans for the proposed work, prepared by Donald J. Norbut, P.E. of the fine of T&M Associates, Consulting and Municipal Engineers, Eleven Tindall Road, Middletown, New Jersey 07748, are on file in the office of the Engineer and may be inspected by prospective bidders during business hours. Bidders will be furnished with a copy of the contract documents and plans by the Engineer upon proper notice and payment of a non-refundable charge of One Hundred Twenty Five Dollars ($125.00) to defray the cost thereof. Proposals must be made on the Standard Proposal Forms in a manner designated in the contract documents, must be enclosed in sealed envelope bearing the name and address of the bidder and the name of the work on the outside, addressed to the Borough of Keyport and must be accompanied by all items identified in the Contract Documents including, but not limited to, a Statement of Consent of Surety from a surety company holding a Certificate of Authorization to do business in the State of New Jersey and a bid guarantee (Proposal Security) for not less than five percent (5%) of the amount bid. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27. Bidders are also required to comply with other provisions of Law including, but not limited to, the requirements of: N.J.S.A. 52:25-24.2 (P.L. 1977, c.33, Disclosure of Ownership) N.J.S.A. 52:32-44 (P.L. 2004, c. 57, Business Registration) N.J.S.A. 34.11-56.25, et seq. (P.L. 1963, c. 150, Prevailing Wages) N.J.S.A. 34.11-56.48 (Public Works Contractor Registration) The contract shall not be approved until a favorable eligibility determination has been made by the New Jersey Department of Transportation. This contract is expected to be funded in whole or in part using funds from the American recovery and reinvestment Act (ARRA). Section 1605 of the ARRA prohibits the use of these funds unless all iron, steel and manufactures goods are produced in the United States. All iron and steel manufacturing processes must take place in the United States, except metallurgical process involving refinement of steel additives. There is no requirement for the origin and subcom ponents of manufactures goods. Products listed at 48 CFR 25.104(a) have been determined to be unavailable in the United States and if required for the project may be purchased from foreign sources.
